Replacement vehicle - If you are the innocent party involved in the accident,
you are entitled by law not to be disadvantaged as a result. As the
driver of the vehicle, you have the right to expect the use of a similar make
and model whilst your own vehicle is undergoing repair and the costs associated
with the hire paid by the guilty party.
If you are at fault, either fully or partially, you will be provided with one
of two alternatives:
Courtesy Car Provision or Upgrade Facility
If your vehicle is undriveable we also provide a 24 hour roadside recovery
service for accident related emergencies.
If you are unfortunate enough to be injured in a non-fault incident we also
provide a complementary Uninsured Loss Recovery & Personal Injury recovery
service along with complementary legal assistance and advice. Delivery of
replacement vehicle to location that suits you and onward delivery of damaged
vehicle to nationwide network of repairers via professional uniformed delivery
drivers.
Your Legal Entitlement
If you are the innocent party involved in a non-fault road traffic accident, we can provide you with a vehicle of equal value. The law entitles you to not to be disadvantaged as a result of a non-fault accident and you have the right to direct the repair to a repairer of your choice and to hire a similar vehicle for the duration of the repair period with all the costs associated with the hire and the repair paid by the guilty party’s insurance company.As the owner the vehicle, you may well expect to have use of a similar vehicle whilst your own car is off the road undergoing repairs. Provided that we are satisfied that you are the non-fault driver and have need of a prestige vehicle, we are prepared to enter into a hire and repair agreement with you and undertake to collect the hire and repair charges plus any other uninsured losses from the guilty third party driver’s insurance company, on your behalf.
We are legally obliged to ensure that you, our client, sign a hire and repair agreement as without such a contract we would not be able to recover the cost of the car hire and repair from the third party insurer.
